§ 536-32. Permits required. Any person, owner or authorized agent who intends to conduct any development in a flood hazard area shall first make application to the Floodplain Administrator and shall obtain the required permit. Depending on the nature and extent of proposed development that includes a building or structure, the Floodplain Administrator may determine that a floodplain development permit or approval is required in addition to a building permit.

C. 7:13. Section 536-32 requires any person, owner or authorized agent who intends to conduct development in a flood hazard area to first apply to the Floodplain Administrator, who the Township designates as the Township Engineer under Section 536-14, and obtain the required permit before work begins; a separate building permit may also be required. Section 536-33 requires the written application to identify and describe the development, describe the parcel by legal description or street address, state the intended use and occupancy, and be accompanied by a site plan, construction documents and grading and filling plans.
Hamilton Township was accepted into the National Flood Insurance Program on June 15, 1982, and flood hazard areas are mapped using the effective Flood Insurance Study for Mercer County dated July 20, 2016 together with its accompanying Flood Insurance Rate Maps. Maps and studies establishing the flood hazard areas are kept on file at the Floodplain Administrator's office at 2090 Greenwood Avenue.

Section 536-8 makes any construction, relocation, extension, conversion or alteration of structures or land without full compliance with the chapter a violation under N.J.S.A. 40:49-5, punishable by a fine of up to $2,000, up to 90 days' imprisonment, or up to 90 days of community service, with each day of a continuing violation a separate offense after a 30-day cure period. Unlawful solid waste disposal in a floodway or floodplain under Section 536-9 carries a fine of not more than $2,500, up to $10,000 for a repeat violation under N.J.S.A. 40:49-5.
