Summary
Stearns County overlays a Floodplain Overlay District on the floodway, flood fringe and general floodplain areas of the unincorporated county under Ordinance 439, Sec. 10.1. A Director-issued permit is required before building, filling, excavating or altering land in these areas, and structures must be elevated above the Regulatory Flood Protection Elevation.
The purpose of this district is to regulate development in the flood hazard areas of Stearns County. The flood hazard areas are subject to periodic inundation and may result in potential loss of life and property, both of which affect the public health, safety and general welfare. This Ordinance is adopted to comply with the rules and regulations of the National Flood Insurance Program codified as 44 Code of Federal Regulations Parts 59-78, as amended, so as to maintain the community's eligibility in the National Flood Insurance Program.
Full Breakdown
R. Parts 59-78 (Sec. 1). The district is an overlay superimposed on every underlying zoning district and applies only in the unincorporated areas of the county (Sec. 2); it does not reach St. Cloud, Sartell, Sauk Centre, Melrose or Cold Spring, which administer their own floodplain controls. The Regulatory Flood Protection Elevation is set one foot above the elevation of the regional (100-year) flood, plus any rise caused by floodway encroachment (Sec. 4). In the flood fringe, most structures must be elevated on fill so the lowest floor, including any basement, sits at or above that elevation, with fill extending at least 15 feet beyond the structure and finished no more than one foot below the protection elevation; small accessory structures under 576 square feet may instead be floodproofed (Sec.
B). Placing more than 1,000 cubic yards of fill on a parcel, or leaving a structure unelevated or floodproofed, requires a conditional use permit (Sec. C). Before any building, addition, fence, dam, on-site septic system, fill placement, excavation, or change of use in the district, the owner must secure a permit from the Director, who must also confirm the applicant holds any required state and federal permits and, for watercourse alterations, notify the DNR Commissioner and FEMA's Chicago Regional Office (Sec. 21). 9 using regional flood elevation data and site history (Sec. 6).
Violations & Fines
Alleged violations are referred to the Director, who investigates and, if a violation is found, issues an administrative order specifying the corrective action, a deadline to comply, and the owner's right to appeal (Sec. 12.2). The order and violation report are personally served on the record owner, who has ten business days to appeal to the Board of Adjustment under Minnesota Statutes Sec. 394.27, subd. 6, by serving written notice on the Department (Sec. 12.3-12.4). If no appeal is filed, the report and order become a final decision; the Board holds a hearing on any appeal and can uphold, reverse or amend the order, with further appeal running to district court (Sec. 12.5-12.6).
