Wake County enforces the Neuse Stormwater Rules (15A NCAC 02B .0235) county-wide and the Falls Lake Nutrient Strategy (15A NCAC 02B .0277) in the northern watershed. New development must control peak flow, nitrogen loading, and 50-ft riparian buffers per Wake UDO Article 9.
Wake County's stormwater program covers post-construction stormwater on new development. All sites must demonstrate: (1) peak flow control of the 1-year, 24-hour storm to predevelopment levels; (2) nitrogen export of 4.0 lb/acre/year or less; (3) 50-ft riparian buffer protection on perennial and intermittent streams. The Falls Lake Watershed adds phosphorus limits. Stormwater Control Measures (SCMs) include bioretention cells, dry detention basins, sand filters, wet ponds, and permeable pavement. SCMs require operation & maintenance agreements recorded with the deed. Wake County Watershed Management inspects SCMs every 5 years.
Failing to install SCM: civil penalty up to $25,000/day under NCGS Β§143-215.6A. SCM disrepair: cure period plus civil penalty. Owner remains liable for SCM maintenance in perpetuity.
