Section 175-140 of the Monroe Township Code, Stormwater management, was adopted by the Township Council and amended most recently on 11-22-2021 by Ordinance O:25-2021. It sets minimum controls for major development, consistent with the statewide stormwater rules at N.J.A.C. 7:8. A major development is one that disturbs one or more acres of land since February 2, 2004, creates 1/4 acre or more of regulated impervious surface since February 2, 2004, or creates 1/4 acre or more of regulated motor vehicle surface since March 2, 2021.
Outside the Pinelands, the section applies to nonresidential major developments, all site plans and subdivisions for major developments needing preliminary or final review, and all major development projects undertaken by the Township. Development inside the Pinelands Area is handled in section 175-140.1.
Under subsection C, measures must provide erosion control, groundwater recharge, stormwater runoff quantity control and stormwater runoff quality treatment, and the recharge, quality and quantity minimums must be met by incorporating green infrastructure. For quantity, post-construction peak runoff rates for the two-, ten- and 100-year storm events are limited to 50%, 75% and 80% of the preconstruction peak rates. For recharge, the design engineer must show that 100% of the average annual preconstruction recharge volume is maintained, or that the increase in runoff volume for the two-year, twenty-four-hour storm is infiltrated. That recharge standard does not apply to sites that create less than one acre of disturbance. Runoff quality standards apply when a development adds 1/4 acre or more of regulated motor vehicle surface.
Every major development needs a maintenance plan under subsection J, listing preventative maintenance tasks and schedules, cost estimates, the location of each measure by longitude and latitude and by block and lot, and the person responsible. The plan is recorded on the deed, and a deed notice for each stormwater measure must be filed with the County Clerk, with proof submitted before construction begins. The Township also requires soil erosion and sediment control plans under section 175-136.
