Under § 286-11 a release of nonhazardous materials is reported to the City of Troy no later than the next business day, with written confirmation mailed within three business days, and a hazardous release goes to emergency dispatch immediately. Under § 286-10 the SMO can enter and inspect facilities as often as necessary and can seek a search warrant from a court if refused access. Violations & Fines
A first offense under § 286-12 is a violation punishable by a fine not exceeding $350 or imprisonment not to exceed six months, or both. A second offense within five years carries a fine of not less than $350 nor more than $700, and a third or later offense within five years carries not less than $700 nor more than $1,000. Each week of continued violation counts separately. The SMO can also order cleanup and restoration and charge the violator for the work.
