Bethel, CT Fence Regulations: Height Limits (2026)

Section 118-6.5B sets the baseline: a fence or wall may not exceed four feet in height within a front setback, or six feet within a side or rear setback. Two exceptions raise that ceiling: a property keeping horses, ponies or livestock under § 118-6.11 may run a fence up to six feet through the front setback, and a residential lot abutting a commercial or industrial use may build up to eight feet. Once a fence sits outside any required setback altogether, § 118-6.5B(3) allows it to reach a full eight feet regardless of the zoning district.

Corner lots carry an additional layer of control under § 118-6.7, Obstructions at intersections: in any residential zone, no fence, wall, building or other obstruction to vision may exceed three feet above the gutter elevation inside the triangular area formed by the two intersecting street lines and a line connecting points 25 feet from the corner on each street line. That triangle rule applies regardless of the four-, six- or eight-foot standards elsewhere in § 118-6.5, so a fence that would otherwise be legal at a mid-block lot can still be cited if it blocks sightlines at an intersection.

The Zoning Enforcement Officer administers all of Chapter 118 under § 118-9.2. These regulations took effect May 15, 2025, replacing the 2009 zoning code, so a fence permitted under the old rules should be checked against these current limits.
