Greece, NY Fence Regulations: Height Limits (2026)

Article VI of the Zoning Code (§§ 211-50 through 211-53), amended August 21, 2025 by Local Law No. 1-2025, sets fence height by location on the lot. Section 211-50B requires a Building Inspector permit before any fence or wall goes up, and 211-50A applies the same rules to walls built to serve a fence's purpose. Height is measured from the top of the fence to the ground directly beneath it (211-50C), except fences on decks or aboveground pools, measured from the deck or pool walking surface instead.

In front and corner yards, fences are capped at four feet and must be of open construction under 211-50L; closed (solid) construction is reserved for side and rear yards, which carry a six-foot cap under § 211-51. Inside the clear-visibility triangle at a street intersection defined by § 211-36, no fence, wall, sign or ornament may exceed three feet, measured at the edge of pavement. Rear and waterfront yard fences must also drop to open construction and four feet if the lot is a corner lot abutting a neighbor's front yard, or if the fence sits within 20 feet of the rear line on a through lot or waterfront lot.

A deck fence may reach six feet if it sits in the rear yard and meets the principal-building setback. Fences on vacant lots are capped at four feet, open construction only. Barbed wire and electrified fencing are banned townwide except for licensed stables under § 211-33, and fences must sit at least two feet off a public sidewalk.
