Town of Cheektowaga Code § 260-59F(3)(a) governs permitted obstructions in a required rear yard, or in any part of an interior side yard that is not a front yard equivalent. " The only carve-out in that same subsection is for tennis court enclosures, which may rise to 12 feet in any district because they are treated as a distinct accessory structure rather than a boundary fence. The six-foot cap and the wire ban sit inside Article VI, Supplemental Regulations, § 260-59, "Supplemental lot size and open space regulations," which also lists what does NOT count as an obstruction in required open space, such as low retaining walls, flagpoles under 20 feet and roof overhangs under one foot.

A separate visibility rule at § 260-59E bars any fence, wall, hedge, shrub or tree foliage between three and seven feet high inside the sight triangle at a street intersection, so even a compliant wood or chain-link fence can still be ordered altered if it blocks a driver's line of sight at a corner lot. Property owners installing a new rear or side yard fence must keep both limits in mind: the six-foot height ceiling and the outright ban on barbed, razor or concertina wire and similar security topping, before the Code Enforcement Office signs off on the work.
