The UDO does not ban specific fence materials for ordinary residential fences. On large rural lots, taller fences are permitted where they are see-through, such as split-rail or chain-link, and electric fences need a special use permit.
Durham's joint City-County UDO regulates fence height and location rather than prohibiting particular materials for standard residential fences. It does tie certain height allowances to transparency: on larger lots a fence taller than usual may be permitted where it can be seen through by virtue of its material, such as split-rail or chain-link. Electric fences are treated separately, allowed up to 10 feet only with a Minor Special Use Permit. Barbed wire and similar treatments are typically limited to non-residential contexts.
Installing an electric fence without the required permit, or a nonconforming taller fence, is a zoning violation enforced under NCGS 160D with civil penalties.
