CT retains the historical “fence viewer” system (CGS §47-49) for boundary fence disputes. Spite fences over 6 feet are prohibited (CGS §52-570).
Connecticut retains the historical “fence viewer” system under CGS §47-49 for boundary fence disputes. When adjoining landowners cannot agree, town-appointed fence viewers may inspect and allocate responsibility. Each property owner is generally responsible for their own fence. Spite fences (over 6 feet, built maliciously) are actionable under CGS §52-570. Disputes can also be resolved through mediation or Superior Court.
Spite fence: civil action for damages + injunction. Fence viewer determination: binding allocation. Small claims for disputes under $5,000.
