Most residential fences under 6 ft do not need a building permit, but must pass zoning review. Walls over 6 ft, retaining walls over 3 ft, and any fence in a historic district require a permit.
Under Atlanta Code Ch. 158 (Zoning), fences up to 4 feet are permitted in front yards and up to 8 feet in side and rear yards in most residential districts without a building permit. A zoning compliance check at the Office of Buildings confirms height and setback rules. Walls over 6 feet and any structural retaining wall taller than 3 feet (per the Georgia amendments to the IRC) require a building permit and engineered drawings. Any fence proposed within a Historic Preservation district (Grant Park, Inman Park, Martin Luther King Jr. Landmark District, Cabbagetown, etc.) requires a Certificate of Appropriateness from the Atlanta Urban Design Commission, regardless of height.
Fences built without required permits must be removed or made compliant. Historic district violations can trigger fines up to $1,000 per day.
