Summary
In the designated U.S. Highway 280 Corridor, Jefferson County requires a site plan submitted to the Department of Development Services before any building permit, including for fences and walls, will be issued. The Director must find the site plan documents full compliance with the corridor's overlay standards before the permit is granted.
1502.02 Administration. Prior to the issuance of any building permit for property located in the designated corridor of U.S. Highway 280 (as depicted on the U.S. 280 Corridor Map), hereinafter referred to as “the Highway Corridor”, the property owner, or his or her agent, shall submit a site plan and accompanying information to the Department of Development Services. Such building permit will then only be issued upon determination by the Director of the Department of Development Services that the site plan and accompanying information sufficiently documents both the ability and the intent of the developer/property owner, and of the development or other proposed improvements themselves, to fully comply with the regulations and requirements of this Section as well as all other applicable provisions of this Resolution.
Full Breakdown
S. Highway 280 Overlay District, applying stricter standards to property in the mapped corridor whenever this Section's requirements exceed the county's normal zoning rules. Its Administration provision requires that, prior to issuance of any building permit for property in the Highway Corridor, the property owner or agent submit a site plan and supporting information to the Department of Development Services; the permit issues only after the Director determines the site plan documents both the ability and intent to fully comply with Section 1502 and the rest of the Zoning Resolution.
The follow-on Application for Site Plan Approval provision spells out what a fence-building applicant must show: the site plan must depict existing and proposed structures, expressly including fences and walls, along with signs, trash containers, light poles and mechanical equipment, plus dimensions, property lines, easements and required buffers. Read together, that means any fence or wall erected within the mapped 280 Corridor triggers the site-plan/building-permit process before it can be built, in addition to meeting the corridor's separate fence-and-wall material standards. This permit trigger is specific to the Highway 280 Corridor overlay; the base building-permit exemption threshold for ordinary residential fences elsewhere in unincorporated Jefferson County sits in the adopted International Residential Code, which the county's local amendments do not restate, so that general county-wide threshold cannot be quoted from this source.
Violations & Fines
Erecting a fence without the required Highway 280 Corridor site plan and building permit is enforced as a zoning violation under the Administration and Enforcement article: it is a class B misdemeanor, with each day of continued noncompliance a separate offense. The Building Commissioner, designated by the Jefferson County Commission, must issue a written notice to cease and desist before prosecuting, and the county can alternatively seek an injunction, mandamus or abatement order to remove an unpermitted fence.
