Summary

A fence over seven feet tall on an interior property line in unincorporated Sacramento County needs an approved building permit, set back three feet from the line, or a Special Development Permit instead.

City-specific rules exist: Elk Grove, Rancho Cordova, and Sacramento have their own fence permit requirements rules that differ from Sacramento County's county-level regulations. If you live in one of those cities, check the city-specific page instead.

Fences over seven feet in height are permitted when setback three feet from an interior property line after first securing an approved building permit. Fences over seven feet in height may be permitted on interior property lines with a Special Development Permit approved by the Zoning Administrator. Fence height may be modified by a condition of approval where the Zoning Administrator finds that due to site features different screening requirements are necessary.

Full Breakdown

Zoning Code Section 5.2.5.B.6 allows fences over seven feet on interior property lines once the owner secures an approved building permit and sets the fence back three feet from the line. As an alternative, an over-height interior-line fence may be permitted with a Special Development Permit approved by the Zoning Administrator, who can modify the height requirement based on site conditions.

Violations & Fines

Erecting a fence taller than seven feet on an interior property line without the building permit or a Special Development Permit is a zoning violation subject to code enforcement action.
