The California Swimming Pool Safety Act (Health and Safety Code Sections 115920-115929) requires that every new residential swimming pool or spa in Sanger have at least one of seven approved safety features, with an enclosure being the most common. Pool barriers must be at least 60 inches (5 feet) in height and must not have openings that allow a sphere greater than 4 inches in diameter to pass through. Gates in pool barriers must be self-closing and self-latching, with the latch mechanism at least 54 inches above the ground on the pool side if the release is accessible from outside. When the house wall serves as part of the pool barrier, all doors opening to the pool area must have self-closing devices and alarms. For existing pools, at least one approved safety feature from the list in H&S Code 115922 must be in place when the property is sold. The Sanger Building Division inspects pool barriers as part of the pool construction permit process. Mesh removable pool fences meeting ASTM F2286 standards are acceptable as one of the approved safety features.
Failure to install required pool barriers is a building code violation enforced through the Sanger Building Division. Noncompliant pools may not pass final inspection. Property sellers must disclose pool safety feature compliance. Drowning incidents at noncompliant pools create significant civil and potentially criminal liability.
