Full Breakdown

Section 10-4.01(e) is the Jacksonville Beach rule for backyard fire pits and warming fires. It says recreational or warming fires can be allowed only if six things are true at once. A UL approved container is used, or a container otherwise approved by the fire official. A garden hose connected to a water source is within twenty-five (25) feet. Combustible material has been cleared away from the container. Yard debris or trash is not being burned. Nuisance smoke is not being created. And the fire is attended at all times. Miss any one and the fire is outside the allowance.

This is separate from the permitted open burning in subsection (b), which covers land clearing, ceremonial situations and special events, requires a permit from the fire official, and sets a fifty (50) foot distance from a structure. Subsection (e) does not repeat a distance figure, so the container, hose and clearing conditions are the printed standards for a recreational fire.

Subsection (f) sets the outer boundary. Trash and rubbish fires are prohibited at any time, and the material listed includes wiring, household waste, yard collections, construction debris, or other similar material. Burning leaves or grass is prohibited. A fire pit therefore cannot be used to dispose of yard waste.

The beach is closed to this kind of fire completely. Subsection (g) states that there are no open fires, campfires, grills, or other cooking or heating devices on the beach. Chapter 6, Article III, the Atlantic Ocean Beach rules, repeats the ban.

The fire official named in these subsections is part of the city's Fire and Life Safety program under Chapter 10, and the Fire Marshal's office interprets the fire code.

Violations & Fines

Section 10-4.01 prints no fine in its text. A fire missing the container, hose, clearing or attendance conditions, or one burning trash, yard debris, leaves or grass, violates the Fire and Life Safety chapter. A person who disagrees with the Fire Marshal's office about how the fire code applies can use the appeal procedure in Article V of Chapter 10.

Frequently Asked Questions

Can I have a fire pit in my yard in Jacksonville Beach?
Section 10-4.01(e) allows recreational or warming fires if a UL approved container (or one approved by the fire official) is used, a garden hose connected to water is within twenty-five (25) feet, combustibles are cleared, no yard debris or trash burns, and the fire is attended at all times.
Can I burn yard waste in a fire pit?
No. Recreational fires cannot burn yard debris or trash, and subsection (f) separately prohibits trash and rubbish fires at any time, including yard collections, and prohibits burning leaves or grass.
Can I leave a fire pit burning while I go inside?
No. The fire must be attended at all times, and a garden hose connected to a water source must be within twenty-five (25) feet. Nuisance smoke is also not allowed under subsection (e).
Are beach bonfires allowed?
No. Section 10-4.01(g) states that there are no open fires, campfires, grills, or other cooking or heating devices on the beach. Open burning permits from the fire official do not override that flat beach prohibition.
