Full Breakdown

Section 16-11(b)(1) prohibits four acts: selling, possessing, using and exploding fireworks. It names persons, firms, copartnerships and corporations, so sellers are covered along with individual users, and it applies within the municipal boundaries of the City of Jacksonville Beach. Fireworks found in violation are confiscated and destroyed.

The definition is broad. Fireworks means any combustible or explosive composition or substance, or combination of substances, and any article prepared to produce a visible or audible effect by combustion, explosion, deflagration or detonation, including blank cartridges and toy cannons in which explosives are used, firecrackers, torpedoes, skyrockets and roman candles. Items listed in F.S. § 791.01(4)(b) and (c) are carved out of the city definition.

Sparklers are exempt from the ban. A sparkler is a device that emits showers of sparks upon burning, contains no explosive compounds, does not detonate or explode, is hand held or ground based, cannot propel itself through the air, and contains not more than one hundred (100) grams of the chemical compound that produces sparks. A sparkler the division has not approved is classified as fireworks, which puts it back under the ban. The division is the division of the state fire marshal of the department of financial services.

The one permitted route is a supervised public display. Subsection (b)(3) says the City of Jacksonville Beach has the authority to authorize the granting of permits for supervised public displays within the municipal boundaries, as provided in F.S. § 791.02(1). The history note lists Ord. No. 2004-7874 (6-7-04) and Ord. No. 2011-8002 (9-19-11).

Violations & Fines

Any person violating any provision of § 16-11 is guilty of an offense punishable by a fine of fifty dollars ($50.00) per violation, payable within ten (10) days to the Utility Billing Office, City Hall, or the Records Clerk, Police Department. A late fee of ten dollars ($10.00) is attached to any fine not paid by the due date. Fireworks found in violation are confiscated and destroyed.
