Apple Valley, MN Fire Regulations: Fireworks (2026)

Section 130.07 of the Apple Valley Code of Ordinances, enacted by the Apple Valley City Council in Dakota County, adopts M.S. §§ 624.20 to 624.25 by reference and then adds local rules. It sorts products into two groups. Consumer fireworks are the items the section defines by weight, such as wire or wood sparklers of not more than 100 grams of mixture per item, snakes and glow worms, smoke devices, party poppers and toy pistol caps. Every other substance or article made to produce a visible or audible effect by combustion or explosion counts as fireworks, and it is unlawful to sell, offer for sale, store, possess, use or explode it in the city except as M.S. §§ 624.20 through 624.25 permit.

Consumer fireworks carry their own city limits. No person under the age of 18 years can purchase them. Discharge is barred between 10:00 p.m. and 8:00 a.m., with two adjustments: on July 4 the prohibited hours run from 11:59 p.m. on July 4 to 8:00 a.m. on July 5, and on January 1 they run from 12:30 a.m. to 8:00 a.m. Consumer fireworks cannot be kept, stored, used, permitted or discharged on any public property or on any public street or right-of-way. Subsection (C)(3) also bars throwing or tossing any fireworks or consumer fireworks at a person, animal, vehicle, thing or object, bars discarding them from a vehicle whether moving or not, and bars using consumer fireworks inside any building or structure.

Selling is a separate track under Chapter 120. The Apple Valley Fire Department, Fire Prevention Bureau issues a separate license for each fixed place of sale, and no license is issued for a mobile business location. The license cannot be transferred, expires on December 31 each year, and the fee is set in Chapter 35, Appendix A. License conditions include no sales on residential property or mixed-use property that includes residential, at least two exits, display aisles at least 48 inches wide, a display height of no more than six feet, photo identification checked at each sale, no smoking within 50 feet of sale and storage areas, no discharge within 100 feet of the selling building, and liability insurance of $1,000,000.00 per claim with the city named as additional insured. Buildings without an approved automatic sprinkler system are limited to 50 pounds net pyrotechnic composition, and sprinklered buildings to 100 pounds.
