Boise City Code Title 5, Chapter 16 aligns with Idaho State Fire Marshal rules under Idaho Code Title 39, Chapter 26. Only non-aerial common fireworks such as ground spinners, fountains, sparklers, and smoke devices are permitted. Aerial devices, bottle rockets, firecrackers, and mortars are illegal statewide without a display permit. Discharge is permitted only during the two state-sanctioned windows. Boise Fire Department enforces strict bans during elevated fire danger days, including hard stops in the Wildland-Urban Interface (WUI) and Foothills overlay where fireworks of any kind may be banned by emergency proclamation. Retail stands must be licensed by the State Fire Marshal.
Use of illegal aerial fireworks: misdemeanor, up to $1,000 fine and/or 6 months jail. Civil penalties for discharge outside windows start at $300. Fires caused by fireworks incur full cost recovery for suppression.
