Des Plaines, IL Fire Regulations: Fireworks (2026)

Illinois does not allow consumer fireworks. The Pyrotechnic Use Act, 425 ILCS 35/2, makes it unlawful to knowingly possess, offer for sale, sell at retail, or use or explode any display fireworks, flame effects, or consumer fireworks except under a permitted, supervised display. Consumer fireworks are defined in 425 ILCS 35/1 as devices meeting U.S. Consumer Product Safety Commission rules (16 C.F.R. Parts 1500 and 1507); the statute expressly excludes sparklers, snake or glow worm pellets, smoke devices, and trick noisemakers ('party poppers,' 'snappers,' etc.), whose sale and use are permitted at all times. The Office of the Illinois State Fire Marshal administers and enforces the Act. Because Des Plaines is bound by this statewide prohibition, residents may use only those exempt novelty items; bottle rockets, Roman candles, firecrackers, and aerial shells remain illegal even if bought legally out of state.
