The exemption expressly covers, 'without limitation: grading; excavation; demolition; alteration; repair; landscape and hardscape work; loading, unloading, moving, or preparing any materials, supplies, equipment or personnel; and the idling of engines of motor vehicles exceeding eight thousand (8,000) pounds' gross vehicle weight, while such vehicles are standing upon or adjacent to work sites.' Because the exemption only operates within these windows, construction noise before 7 A.M. or after 7 P.M. on a weekday is measured against the general 65 dBA daytime / 50 dBA quiet-hours limits of 6-2-7(E) and can be cited. The City Council may grant a date-specific variance after public review under 6-2-7(B)(2).
Work outside the exempt hours is subject to the noise penalty in City Code Title 1, Chapter 4, for each offense (6-2-7(G)).
