The Fireworks Regulation Act of Illinois (425 ILCS 30) defines "fireworks" to include firecrackers, torpedoes, sky rockets, Roman candles, bombs and "any fireworks of like construction," and prohibits their sale, possession and use without a permit. The Act expressly excludes "snake or glow worm pellets; smoke devices; sparklers; trick noisemakers known as 'party poppers', 'booby traps', 'snappers', 'trick matches', 'cigarette loads' and 'auto burglar alarms'" and toy caps — these novelties are the only consumer items legal statewide. Display fireworks require a licensed operator and permit under the Pyrotechnic Use Act (425 ILCS 35). Kane County does not create a local exception.
A first violation is a petty offense; failing to comply after written notice from the Office is a Class A misdemeanor (425 ILCS 30/25). Local police also enforce.
