Elgin, IL Fire Regulations: Fireworks (2026)

020 of the Elgin Municipal Code makes it unlawful to knowingly possess, offer for sale, sell at retail, or use or explode any display fireworks, flame effects, or consumer fireworks without a city permit, and separately holds property owners liable for failing to prevent a violation on property they control. 030 governs pyrotechnic display permits: the written application must be filed at least fifteen days ahead, identify a licensed lead pyrotechnic operator and licensed distributor, and be backed by at least $1,000,000 in occurrence-based liability insurance before the fire chief inspects the site and issues a non-transferable permit; indoor displays additionally require sprinklered buildings.

040 sets a parallel process for consumer fireworks displays, requiring a fifteen-day advance application, proof the handling individual completed state-approved training, a criminal background check disqualifying any applicant with a felony or fireworks-sale conviction, and at least $250,000 in liability insurance. 050 requires consumer distributors and retailers to register with the state fire marshal and bars selling more than 499 pounds of consumer fireworks to one person without state approval. 060 bans discharging fireworks within 600 feet of a hospital, asylum, or infirmary and prohibits selling or using sparklers on any city property.

070 sets the penalty: up to $750 for a first offense, $150 to $750 for a second, $500 to $1,500 for a third, and a flat $1,500 for a fourth or subsequent offense, with each day a separate offense.
