Lakewood Codified Ordinances Section 549.10 prohibits the discharge of consumer fireworks within the city. No person shall discharge, ignite, or explode any fireworks in the Municipality except for licensed exhibitors of fireworks authorized to conduct fireworks exhibitions under state law. Fireworks manufactured, sold, possessed, transported, or used in violation of the section are subject to forfeiture. Although Ohio Revised Code Section 3743.45(B) otherwise permits 1.4G consumer fireworks to be discharged on private property on roughly a dozen enumerated holidays each year, Section 3743.45(D)(2) expressly authorizes a municipal corporation to ban that discharge. Lakewood has exercised that authority, so the state holiday allowances do not apply within the city.
Whoever violates Section 549.10 is guilty of a misdemeanor of the first degree, and the fireworks involved are forfeited.
