Under Florida Statute 791 and Miami Beach local regulations, consumer fireworks (aerial devices, firecrackers, roman candles, etc.) are prohibited except during state-authorized dates: July 4th, New Year's Eve, and New Year's Day. Even on authorized dates, use on the beach may be restricted due to environmental regulations including sea turtle nesting season (April 1 through October 31). Professional fireworks displays for special events require a permit from the Miami Beach Fire Department, which must be applied for by a licensed and insured contractor at least 30 days prior to the event and approved no later than 11 days before. A minimum of two firefighters must be present from delivery through cleanup. Sparklers and other novelty items (snakes, glow worms, smoke devices) classified as permissible under Florida law do not require permits. The Fire Prevention Bureau at (305) 673-7108 handles fireworks permit applications.
Illegal fireworks use is a first-degree misdemeanor under Florida law, punishable by up to one year in jail and $1,000 fine. The city may also impose code enforcement fines. Contact Fire Prevention at (305) 673-7108.
