Florida Statute Section 791.08 allows the personal use of consumer fireworks on July 4th, New Year's Eve, and New Year's Day. This supersedes the previous agricultural exemption loophole. Consumer fireworks include Roman candles, bottle rockets, and firecrackers sold at licensed retail locations. Fireworks must be used on private property with the property owner's permission and cannot be discharged on public streets, parks, or rights-of-way without a permit. Large fireworks displays for events require a permit and must be conducted by a licensed pyrotechnician. Homestead's proximity to Everglades National Park, agricultural nurseries, and tropical vegetation creates elevated fire risk from fireworks. The fire department may issue restrictions during dry conditions. Sparklers and small novelty items are available year-round. The sale of consumer fireworks is only permitted by licensed dealers. Using fireworks while intoxicated is prohibited.
