Fireworks in Nampa are controlled primarily by Idaho state law, the Fireworks Act of 1997 (Idaho Code Title 39, Chapter 26). Idaho Code 39-2602(6) defines 'nonaerial common fireworks' as ground spinners, fountains, sparklers, smoke devices, or snakes designed to stay on or near the ground, not travel outside a 15-foot circle, and not emit sparks or burning material outside a 20-foot circle or above 20 feet in height; firecrackers and jumping jacks are excluded. Aerial and other 'special fireworks' are not legal for general consumer use without a permit, and Idaho Code 39-2609 prohibits selling or using fireworks at any time not permitted by the chapter, altering fireworks, or throwing them at people or vehicles. Idaho Code 39-2606 sets the only legal use/sale windows for nonaerial common fireworks: midnight June 23 through midnight July 5, and midnight December 26 through midnight January 1 (each period may be extended up to five days by the authority having jurisdiction). The City of Nampa is among the Idaho cities that ban the sale of aerial fireworks within city limits. The 'authority having jurisdiction' for permits inside a city is the city fire department (39-2602(1)).
Selling or using aerial fireworks, or using any fireworks outside the legal nonaerial windows, violates Idaho Code 39-2606 and 39-2609. Nampa bans aerial fireworks sales within the city.
