Nampa sets nighttime quiet hours from 11:00 p.m. to 7:00 a.m. During that window it is unlawful to make loud or offensive noise that disturbs a reasonable person. Loud noise plainly audible 100 feet away on a public street, or inside another residence or business, qualifies as a violation.
Nampa City Code Title 6, Chapter 7 (Public Noise Disturbance) governs nighttime noise. Section 6-7-3 makes it unlawful for any person or business, between 11:00 p.m. one day and 7:00 a.m. the next, to make, cause, or allow loud or offensive noise by voice, musical instrument, horn, radio, loudspeaker, automobile, machinery, or other means that disturbs the peace, quiet, and comfort of any reasonable person of normal sensitiveness in the area. The code defines a violation by reference to where the sound is heard: loud or offensive noise is that which is plainly audible inside any other place of residence, business, hospital, farm property with animals, or restaurant, or on a public right of way or street at 100 feet or more from the source. Section 6-7-4 separately limits loud amplification devices in motor vehicles, prohibiting sound plainly audible 50 feet or more away. Section 6-7-5 exempts emergency vehicles, permitted parades and fireworks displays, railroad equipment, safety warning devices, and certain authorized activities. Penalties appear in section 6-7-6.
A violation of the noise chapter is an infraction (6-7-6). A third or subsequent violation within one year of the first conviction is a misdemeanor for each offense.
