Nassau County, FL Fire Regulations: Fireworks (2026)

Section 9-34 makes it "unlawful for any person, firm, co-partnership or corporation to offer for sale, expose for sale, sell at retail, or use or explode any fireworks, unless allowed by state law, except for public display," and any display is allowed only subject to the article's requirements. Section 9-33 defines "fireworks" broadly to include any combustible or explosive composition producing a visible or audible effect, expressly naming blank cartridges, toy cannons, fire balloons, firecrackers, torpedoes, skyrockets, roman candles and "dago bombs," while excluding state fire-marshal-approved sparklers under F.S. § 791.013, low-charge toy caps, and novelty noisemakers under F.S. § 791.01(4)(c).

Section 9-35 sets display hours: it is unlawful to use or explode fireworks "before 7:00 a.m. and after 10:00 p.m., unless approved by the board of county commissioners," and those hour limits do not apply on national holidays. Section 9-36 layers on NFPA 1123 and 1126 for indoor and outdoor fireworks displays. Section 9-37 requires a written permit filed at least 15 days before the display date, issued by county fire rescue, subject to Florida Fire Prevention Code provisions and F.S. § 791.02(1), an applicant meeting with the fire inspector if the inspector deems it necessary, and a fee the board of county commissioners may set by resolution.

The ordinance is titled the "Fireworks Display Ordinance" (§ 9-31) and its stated purpose (§ 9-32) is to regulate supervised public displays by fair associations, amusement parks and other groups outside any municipality, protecting public health, safety and general well-being.
