Noblesville Code of Ordinances Chapter 92 (Fire Prevention Code), as adopted by Ordinance 50-10-09 on October 27, 2009, §92.10 (Fireworks) regulates both public displays and consumer fireworks use. §92.10(B)(1) provides verbatim: "Pursuant to I.C. 22-11-14-10.5, consumer fireworks may only be used in the City of Noblesville, Indiana, corporate limits during the days and times listed in I.C. 22-11-14-10.5(c)(3) which are listed below: (a) Between the hours of 5:00 P.M. and two (2) hours after sunset on June 29, June 30, July 1, July 2, July 3, July 5, July 6, July 7, July 8, and July 9. (b) Between the hours of 10:00 A.M. and 12:00 midnight on July 4. (c) Between the hours of 10:00 A.M. on December 31 and 1:00 A.M. on January 1." §92.10(B)(2): "In the event that the hours of use for consumer fireworks listed in I.C. 22-11-14-10.5(c)(3) are amended, the state statute shall control." These windows are the statewide "protected discharge windows" - IC 22-11-14-10.5 bars counties and municipalities from prohibiting consumer fireworks use during these times. Outside the protected windows, IC 22-11-14-10.5(c)(2) permits a county or municipality to adopt an ordinance limiting consumer fireworks use to its discharge property, the discharge property of someone who has consented, or a special discharge location designated by the State Fire Marshal. Noblesville's §92.10(B) does not separately impose a non-IC-protected-window restriction, so consumer fireworks use outside the protected windows is governed by the underlying state law. For public displays of fireworks (Class 1.3G non-consumer fireworks) within City of Noblesville or Noblesville Township limits, §92.10(A) requires submittal of: a completed IDHS Fireworks Permit Application per IC 22-11-14-2; a Letter of Intent to Display Fireworks listing the sponsor, date, time, location, shell diameters, ground materials, timetable, BATF approval, NFPA 1123 compliance, personnel qualifications, site plan, Certificate of Insurance per IC 22-11-14-3, and contract. The minimum age to purchase or use consumer fireworks in Indiana is 18 (IC 22-11-14-4.5). Indiana State Fire Marshal (IDHS) administers fireworks licensing statewide.
Use of consumer fireworks outside the protected windows in §92.10(B)(1) / IC 22-11-14-10.5(c)(3) is a state law violation enforceable by the Noblesville Police Department and may also be a violation of the Noblesville Fire Prevention Code subject to citation by the Fire Chief or his designee under §92.04(A). Per §92.99(A)(1), violations of the Noblesville Fire Prevention Code are subject to fines up to the maximum penalty prescribed by IC 36-1-3-8(10) ($2,500 first offense, $7,500 for repeat offenses). Public fireworks displays without an IDHS permit under IC 22-11-14-2 or without the §92.10(A) documentation can be ordered to stop by the Fire Chief.
