Rochester Hills, MI Fire Regulations: Fireworks (2026)

The fireworks amendment sits inside Section 58-58(b)'s rewrite of Fire Code Section 5601.1.3, and it starts by flatly prohibiting the manufacture of fireworks anywhere within city limits. For consumer fireworks, ignition, discharge and use is banned outright except during five narrow windows, each starting after 11 a.m.: New Year's Eve into 1 a.m. on New Year's Day, the Saturday and Sunday before Memorial Day, June 29 through July 4, July 5 itself if it lands on a Friday or Saturday, and the Saturday and Sunday before Labor Day, with every one of those days cutting off at 11:45 p.m.

Section 5601.1.3.2(b) adds a second layer: even during those windows, a person can't set off fireworks on public property, school property, church property, or someone else's property without that owner's or organization's express permission. 'Display fireworks,' the large explosive-grade devices used in public shows, are handled separately under Section 5601.1.3.4 and require the code official's rules and regulations plus a competent operator in control of the show. The ordinance carves out several exceptions that keep it from reaching wholesalers, retailers, manufacturers and importers who sell, store, transport or distribute fireworks; railroads, other transportation agencies, or law enforcement using devices for signaling; agricultural or wildlife fireworks; blank cartridges used in shows, sports signaling, or by the military or police; and ATF permit holders handling fireworks incidental to a public display.

If the code official or a law enforcement agency finds a violation, Section 5601.1.3.6 lets them seize the fireworks as evidence, storing them at the violator's expense pending any criminal or civil case.
