Southaven, MS Fire Regulations: Fireworks (2026)

Section 5-2 is titled the Southaven Fireworks Ordinance. It defines the city as the City of Southaven and every place within its corporate limits, and it defines fireworks as firecrackers, Roman candles, torpedoes, sky rockets and any and all explosives commonly known and referred to as fireworks. Auto flares, toy pistols, toy canes, toy guns and other devices that use paper caps made to United States Interstate Commerce Commission packing and shipping regulations sit outside the definition, and the ordinance says the use of those devices shall be permitted at all times.

Subsection (c) is the prohibition itself. No person, corporation or association can manufacture, possess, sell or discharge fireworks within the municipal corporate limits, except through a special supervised public display permit. Because possession is listed alongside discharge, holding fireworks inside the corporate limits without that permit falls within the ban.

Subsection (d) sets the permit route. The fee is $100, payable to the city general treasury. The applicant obtains the application form from the fire department and completes it within ten days of the scheduled display, stating that the applicant will comply with all fire and safety regulations set by the fire department. The applicant also obtains a bond of at least $1,000 to satisfy claims for property damage or personal injury arising from any act or omission at the display. The third condition covers standby firefighters: the applicant pays the City of Southaven hourly rates, set by the fire department and approved by the mayor and board of aldermen, for each piece of fire equipment and each person the fire prevention division deems necessary for the event.

If the fire official concludes that emergency conditions warrant it, the supervised public display permit can be revoked immediately without prior notice, and all money is returned to the applicant.

Two neighboring fire-code provisions are separate from this ordinance. Section 5-3 lists an operational permit fee of $400.00 for Pyrotechnique Special Effects Material, and Section 5-60 makes a violation of the adopted fire code a misdemeanor punishable by a fine of not more than $1,000 and/or imprisonment for up to thirty days.
