In St. Lucie County, Florida law lets residents use consumer fireworks only on three designated holidays: New Year's Day (Jan 1), Independence Day (July 4), and New Year's Eve (Dec 31). Using them any other day remains restricted under state law.
Florida Statute 791.08, added by SB 140 (2020), exempts fireworks use from state prohibitions when done solely on a designated holiday. Outside those three dates, discharging consumer fireworks is not authorized statewide, though the old 'agricultural' loophole once let buyers sign a waiver. St. Lucie County and its cities (Port St. Lucie, Fort Pierce) cannot override the holiday allowance, but HOAs may add safety-based rules that still cannot abrogate the holiday right. Sparklers and other novelties on the approved-list stay legal year-round.
Discharging fireworks outside a designated holiday can be charged as a first-degree misdemeanor under Chapter 791, up to 1 year jail and a $1,000 fine, plus any local nuisance citation.
