Florida law requires working smoke alarms in dwellings. In St. Lucie County, a newly installed or replacement battery-powered smoke alarm must use a nonremovable, nonreplaceable 10-year battery under F.S. 553.883.
Florida Statute 553.883 governs smoke alarms in one-family and two-family dwellings and townhomes. When a battery-powered smoke alarm is newly installed or replaces an existing one during a repair or Level 1 alteration, it must be powered by a nonremovable, nonreplaceable battery that lasts at least 10 years. This exception spares owners from hardwiring during minor renovations, but does not apply to monitored, wireless, or multisensor systems. New construction follows the Florida Building Code, which requires interconnected alarms in each sleeping room, outside sleeping areas, and on every level. Landlords must ensure rentals have functioning alarms.
Missing or non-functioning smoke alarms are a building-code and life-safety violation; the Fire District or building official can require correction, and landlords face liability for non-compliant rental units.
