Under Chapter 42 of the Tomball Code of Ordinances, the discharge of fireworks within the city limits is prohibited. While Texas state law permits the sale and possession of consumer-grade fireworks (UN0336, 1.4G), municipalities have the authority to ban their discharge within city boundaries. Tomball uses this authority to prohibit fireworks discharge citywide. This includes bottle rockets, firecrackers, Roman candles, sparklers over 12 inches, and all aerial fireworks. The sale of fireworks is permitted at licensed stands located outside city limits along the US-249 corridor. Sparklers and other exempt items as defined by state law may still be used. During Fourth of July and New Year's Eve, Tomball PD increases patrols for fireworks enforcement. The city hosts an official Fourth of July celebration with professional fireworks at the Tomball Depot.
Discharging fireworks within Tomball city limits is a Class C misdemeanor with fines up to $500 per offense. Starting fires or causing property damage with fireworks may result in additional criminal charges.
