Troup County, GA Fire Regulations: Fireworks (2026)

The UDO defines the use precisely in Appendix D's definitions section, Section 1.2: "Consumer Fireworks" means any small fireworks devices containing restricted amounts of pyrotechnic composition, designed primarily to produce visible or audible effects by combustion, that comply with the construction, chemical composition, and labeling regulations, a definition that also folds in Roman candles. The code separately defines the structure that sells them: a "Consumer Fireworks Retail Sales Facility" is a permanent or temporary building or structure used primarily for the retail display and sale of consumer fireworks to the public, expressly excluding a tent, canopy, or membrane structure, while a "Consumer Fireworks Retail Sales Stand" is the same use in a structure no larger than 800 square feet.

Zoning-wise, the Section 6.1 Table of Permitted and Prohibited Uses lists "Consumer Fireworks Retail Sales" as permitted by right in the Light Industrial and Heavy Industrial districts, and permitted only with a Special Use Permit in the Urban Village high-density mixed-use district. Every other zoning district in the unincorporated county, Agricultural, Agricultural-Residential, Suburban Residential, Lakeside Residential, Limited and Highway Commercial, Rural Village, and Manufactured Home Park, has no entry for the use at all, which under Section 6.1(1)(b)(iii) means the use is prohibited within that district unless the Community Development Director determines it's similar enough to something else that is listed.

A Special Use Permit application for the UR-VL district goes through the Board of Zoning Appeals and Planning Commission process before the Board of Commissioners acts on it, so a UR-VL retailer can't simply pull a building permit the way an LI or HI facility can.
