Layton, UT Fire Regulations: Outdoor Burning (2026)

Section 16.16.020 states the core rule plainly: no person may burn trash, garbage or other waste, or conduct a salvage operation by open fire, except as allowed under §§ 16.16.030 and 16.16.040. Section 16.16.030 lists narrow categories that need no permit at all, among them agricultural burning of prunings from orchards of twenty-five or more fruit trees, weed burning along fence lines on cultivated land or irrigation ditches, stubble burning on two or more contiguous acres of cultivated property, frost-protection heating of orchards, outdoor cooking grills and fireplaces, indoor fireplaces, and campfires under three feet in diameter supervised by someone eighteen or older.

Anyone doing one of those permit-free burns still must give the Fire Department the date, place, time, purpose, and the name, address and age of the person in control before starting. Any other kind of open burning needs an individual permit issued by the Fire Department or its authorized agent under § 16.16.040, coordinated through the Utah State Department of Environmental Quality's "clearing index" system, or through Utah Air Conservation Committee approval after a hearing. Burning at community trash or garbage disposal sites is separately banned outright under § 16.16.060 absent a specific committee authorization. The Fire Chief holds rule-making authority over the chapter under § 16.16.080, subject to City Manager and Council review.
