Outdoor burning rules in Palm Beach County, FL β also called the burn ban, open burning, or fire restriction ordinance β set when you can burn yard waste, debris, or run a recreational fire.
Open burning of yard debris in unincorporated Palm Beach County requires authorization from the Florida Forest Service under FL Admin Code 5I-2.006. Agricultural and prescribed burns in the Everglades Agricultural Area are common but separately permitted; residential debris burning is heavily restricted.
Florida Forest Service (FFS) is the sole authority for open burning authorizations under FL Admin Code Chapter 5I-2 and FL FS Β§590.125. Residential yard debris piles must be no larger than 8 feet in diameter, set back at least 25 feet from forests, 25 feet from any paved road, 50 feet from any structure, and 150 feet from any occupied dwelling not on the burner's property. Burning is permitted only between 9 AM and one hour before sunset, and a competent adult must remain on site with suppression equipment. Trash and household garbage burning is prohibited statewide. PBC Air Pollution Control (Health Department) also enforces under PBC Code Ch. 22. Sugarcane pre-harvest burns in the EAA are authorized seasonally by FFS and Florida DEP. During declared drought or burn bans by the Governor or FFS, all open burning is suspended.
Unauthorized burning: PBCFR or FFS citation, fines up to 1,000 dollars under FL Β§590.28; cost recovery for response. Fire that escapes is a separate offense.
