Jupiter, FL Fire Regulations: Outdoor Burning (2026)

Section 10-42 makes it unlawful to cause, assist or participate in open burning of trash, refuse, debris, grass, weeds, wood, natural growth or other material anywhere within Jupiter without first obtaining a town permit. To apply, section 10-43 requires a written application to the fire marshal, with a duplicate filed with the town manager, disclosing the reason for burning rather than other disposal methods, the number and type of residential, commercial and industrial units within a half mile of the burn site, the quantity, type and source of the material, the requested date, time and duration of the burn, the precautions planned to control smoke and hazards, and contact information for the applicant and the landowner.

Under section 10-44, the fire marshal weighs prevailing winds, weather, humidity, atmospheric conditions and the risk of fire, smoke, fumes or nuisance to neighbors before recommending approval or denial, and can attach any limitations or conditions needed for public safety. The town manager makes the final call on issuance or denial under section 10-45, applying the same criteria. Once a permit issues, section 10-46 requires the permit holder to notify the police department, the fire marshal and the town manager immediately before the burn actually begins, and to notify any other agency with jurisdiction over the site as the fire marshal may require.

The fire marshal retains authority under section 10-47 to supervise the burn in person and to modify, halt or reschedule it as circumstances require. 00 to cover the town's cleanup or supervision costs, with the town council setting a higher amount if warranted. A denied applicant, under section 10-49, has ten days to appeal the town manager's decision to the town council by filing notice with the town clerk, and the council's decision on that appeal is final.
