Boca Raton, FL Fire Regulations: Outdoor Burning (2026)

Section 7-1, adopted by Ordinance No. 5726 on February 25, 2025, makes it unlawful to set a fire on any lot, street, alley, or other public or private place within the city without first obtaining a burning permit and paying the fee set in the municipal facilities and services user fee schedule. The application is obtained from the fire rescue services department and reviewed for approval by the fire chief or a designee. Even after approval, the fire chief or designee can revoke the permit if changes in environmental conditions or other circumstances make the previously-approved fire hazardous to the public.

Section 7-3 gives the fire chief and any designee authority to investigate and take all other steps necessary to enforce Chapter 7, and Section 7-26 adopts the Florida Fire Prevention Code, 8th edition, along with a list of specific NFPA standards, as local amendments layered on top of the burning-permit requirement. Section 7-2, adopted the same day, separately authorizes the city to bill any person responsible for an unauthorized hazardous-materials discharge for the full cost of its emergency response, with a 10 percent late fee after 30 days and an added 2 percent for each additional 30-day period unpaid.
