Full Breakdown

Pinellas County Code § 58-210 makes open burning illegal countywide unless it fits one of the narrow exceptions in Article V: 'Any open burning not specifically allowed by this article is prohibited. No person shall ignite, cause to be ignited, permit to be ignited, suffer, allow, burn, conduct or maintain any prohibited open burning.' The same section bars unapproved outdoor heating devices used for cold or frost protection. Section 58-208 confirms the ban embraces 'all territory within the legal boundaries of the county, including all incorporated and all unincorporated areas.' Section 58-211 adds that no permitted burn may reduce visibility on a public roadway below 500 feet or endanger air traffic.

Recreational fires are allowed under § 58-217 but only inside a cleared 'fire ring' at least 15 feet from any structure, using approved solid fuel of clean dry wood or charcoal; treated wood, yard waste, paper and garbage may never be burned there. Grills, camp stoves and other LP-gas or liquid-fuel cookers are exempt from the ban outright. Land-clearing burns (§ 58-214) need a written permit from the fire chief of the district where the burn will occur, must sit at least 50 yards from any occupied building or public highway during daylight hours, or 500 yards away otherwise, and the permit must be kept on site. Agricultural, silvicultural and frost-protection burning is allowed between 9:00 a.m. and one hour before sunset with prior approval from the state division of forestry (§§ 58-212, 58-213). Industrial, commercial and municipal open burning is prohibited outright unless the board of county commissioners and the Florida Department of Environmental Protection both approve it as the only feasible method of operation (§ 58-215).

Violations & Fines

Violating any part of this article is punishable under § 58-207 by a fine of up to $500.00, up to 60 days in the county jail, or both. Each day a continuing violation persists counts as a separate offense. Fire departments and law enforcement may enter the property where the burn is occurring and order the fire extinguished, or extinguish it themselves if it threatens public health or safety (§ 58-217(d)). A land-clearing burn permit can also be revoked for noncompliance or if the fire becomes a smoke, ash or traffic hazard (§ 58-214(b)(3)).

Frequently Asked Questions

Can I have a backyard campfire in Pinellas County?
Yes, if it qualifies as a recreational fire under § 58-217: contained in a cleared fire ring at least 15 feet from any structure and fueled only by clean dry wood, charcoal or manufactured logs. Burning treated wood, yard waste, paper or garbage in it is prohibited, and grills or gas-fueled cookers used strictly for cooking are exempt from the ban entirely.
Do I need a permit to burn brush from clearing my land?
Yes. Section 58-214 requires a written permit from the fire chief of the district where the burn will occur, and the pile must sit at least 50 yards from any occupied building or public highway if burned in daylight, or 500 yards away otherwise. The fire chief can revoke the permit for noncompliance or nuisance smoke.
Does this ban apply inside Clearwater, St. Petersburg or other cities?
Yes. Section 58-208 states the open burning article embraces 'all territory within the legal boundaries of the county, including all incorporated and all unincorporated areas,' so the same prohibitions and exceptions apply whether you live in an incorporated city or the unincorporated county.
What happens if I get caught burning illegally?
Section 58-207 sets the penalty at up to $500.00 and up to 60 days in the county jail, or both, and treats a continuing violation as a new offense every day it persists. Fire or law enforcement personnel may also enter your property to order the fire out or extinguish it themselves.
