Kentucky law (KRS 198B.588) requires working smoke alarms in all residential dwellings, with placement in each sleeping area, outside each sleeping area, and on every story. New construction and substantial renovations must use hardwired, interconnected alarms with battery backup per the Kentucky Residential Code, and rental units must have functioning alarms at the start of each tenancy.
Smoke alarm rules in Lexington follow statewide Kentucky standards rather than a unique local ordinance. KRS 198B.588 and the Kentucky Residential Code (IRC as adopted) require smoke alarms in every sleeping room, in the hallway or area immediately outside each sleeping area, and on each additional story of a dwelling including basements. For new construction and additions requiring a building permit, alarms must be hardwired to household power with battery backup and interconnected so that activation of one sounds all alarms. Existing homes without hardwiring may rely on battery-only alarms, but 10-year sealed lithium battery models are strongly recommended and are now the default option sold in Kentucky. Carbon monoxide alarms are required in dwellings with fuel-burning appliances or attached garages. Landlords of rental units in Lexington must provide functioning smoke and CO alarms at the start of each tenancy, and tenants are responsible for routine testing and battery replacement during occupancy. Lexington Fire Department runs a free smoke alarm installation program for qualifying residents who cannot afford or install their own units. Tampering with or removing a required smoke alarm is a violation of Kentucky law and can create landlord-tenant liability in the event of fire injury.
