Lubbock requires working smoke alarms in all dwellings per IFC and IRC as adopted in city code. Smoke detectors must be installed in every sleeping room, outside sleeping areas, and on every level including basements.
Lubbock has adopted the International Fire Code and International Residential Code (Chapter 14 and Chapter 6 of the City Code). Section R314 requires smoke alarms in every bedroom, immediately outside each sleeping area, and on every story of the dwelling. New construction and substantial renovations require hardwired and interconnected alarms with battery backup. Existing homes may use battery-only alarms but must maintain them in working order. Landlords are required to provide working smoke alarms at the start of every tenancy under Texas Property Code Section 92.251 et seq., and tenants may request installation or repair in writing. Carbon monoxide alarms are required in dwellings with fuel-burning appliances or attached garages. Lubbock Fire Rescue participates in smoke alarm give-away programs in partnership with the Red Cross. Tampering with or disabling an alarm in a rental may violate Texas Property Code.
Landlord failure to install: tenant remedies under TX Property Code, possible civil penalties and one month rent plus 500 dollars. Building code violation: up to 2,000 dollar fine per day.
