Ocala, FL Fire Regulations: Smoke Detectors (2026)

Rather than write its own smoke alarm mandate, the City of Ocala folds it into a single adoption clause. Code of Ordinances Section 38-81(a) states that the current edition of the Florida Fire Prevention Code, as adopted by the state fire marshal, is "hereby adopted by reference," with the building official and the fire chief each required to keep an enforcement copy on file for public inspection. Subsection (b) then makes it "unlawful for any person to violate any of the provisions of the publication adopted in subsection (a)," which is how the city enforces the Fire Prevention Code's smoke alarm chapters as a municipal offense rather than only a state one.

Violations of this division of Chapter 38 are punished under Section 38-83 at the rate set in Section 1-9, a fine of up to $500.00 or up to 60 days in jail, and where a violation is not otherwise specified, every ten days a prohibited condition continues counts as a separate offense. Ocala's code enforcement board or a special magistrate may also take up a Fire Prevention Code violation under Section 38-87, using the hearing authority and procedures of Florida Statutes Chapter 162. Ocala Fire Rescue's fire prevention bureau, created at Section 38-32, is charged with enforcing laws and ordinances covering fire prevention and the maintenance of alarm and extinguishing systems within the city.
