Newton, MA Food Trucks & Mobile Vendors: Food Truck Permits (2026)

Division 3 of Chapter 20 covers motorized and trailer-mounted food trucks. Sec. 20-88 defines a food truck as a readily movable trailer or motorized wheeled vehicle registered with the Massachusetts Division of Motor Vehicles and equipped to cook, prepare or serve food. Sec. 20-89 bars any food truck from operating without a license from the Commissioner of Health and Human Services. A separate location permit from the Department of Planning and Development is required under Sec. 20-91 for any truck that wants to operate on-street; the application must describe the business, state the location and time period sought, describe any signs or objects placed on the sidewalk, prove the vehicle passed a Newton Fire Department inspection, and prove a general liability policy naming the City as an additional insured.

That permit runs up to one year and is revocable for non-compliance; if applications exceed available spots, the Director of Planning and Development allocates them equitably and may deny one to diversify offerings or over a vendor's past operating problems. Sec. 20-92's ten operating rules add a 25-foot length cap, a ban on dining furniture, mandatory public waste containers with a 100-foot litter check, a Styrofoam and plastic bag ban, compliance with the Sec. 20-13 noise ordinance and state grease/greywater rules, a requirement to display the license and permit on the windshield, and a bar on transferring the license without Health and Human Services Commissioner approval. The City, including Police and other inspectional departments, may inspect a truck at any time to confirm compliance.
