Chapter 173, Article III, Peddling Vehicles, added in 1975 and rewritten by Local Law No. ' Section 173-26 then requires a vehicle license from the Town Clerk before anyone sells, peddles or vends from that vehicle. The application under § 173-27 must include the operator's name, address and phone number, copies of all required licenses and permits, a valid New York driver's license, vehicle registration and insurance kept in force for the license term, a description of the vehicle and plate, and a state sales-tax certificate of authority plus a tax clearance certificate.
Section 173-32 requires operators to complete safety training courses the state, county, Town or Nassau County Police or Traffic Safety Board may prescribe, with proof filed with the Town Clerk within three weeks of a course's end. The Town Clerk can revoke or suspend a vehicle license under § 173-29 for fraud or misrepresentation on the application, chapter violations, disqualifying felony or drug convictions, DWI, leaving the scene of an accident, crimes against children, or unpaid fines, after written notice and a hearing (or immediate temporary suspension in urgent cases, with a hearing within ten days).
Licensed vehicles must display a Town-issued 'Peddler' tag under § 173-30, and unlicensed operation or a tag violation can lead to seizure under § 173-34 and forfeiture under § 173-35. A licensee aggrieved by a Town decision may appeal to the Commissioner of the Department of Public Safety within fourteen days under § 173-37.
