Section 26-322(a) bars operating a mobile food unit on city-owned or private property until the owner or a designee has been issued a permit. A single permit lets the permittee operate at up to five different properties, and an applicant can apply for more than one permit if needed. To operate on private property, § 26-322(c) requires a current city business license, a valid Georgia Department of Public Health health permit that must stay valid for the life of the permit, written permission from each private property owner, and a site sketch approved by the director of community development showing access, parking, ingress/egress routes, unit placement, distance from property lines and trash receptacle locations.

A permit is valid for one year from issuance. Fire department rules layered onto the permit process by § 26-323(b) add hardware requirements: a cooking fire suppression system meeting NFPA 17A and UL 300, servicing every six months; a Class ABC extinguisher rated at least 2A20BC, tagged every 12 months; a K-Class extinguisher for grease fires, also tagged every 12 months; posted 'no smoking' signage; secured LP or natural gas tanks with rubber supply hoses stamped for the gas type; and GFCI protection on receptacles near any sink. The fire department checks compliance at licensing and may inspect the unit annually thereafter.
