Full Breakdown
City Code § 26-322(a) limits where a mobile food unit may operate at all: only commercial, mixed-use or perimeter zoned properties qualify, on top of the general permit requirement covering any unit operating on city-owned or private land. Placement rules in § 26-323(a) then narrow the allowed spots further. A unit cannot locate within 100 feet of a single-family or two-family residential use, measured from that use's property line, closing off much of the city's residential-adjacent commercial edge to food trucks. A unit also cannot set up on the same property as an existing restaurant unless the restaurant's owner also owns the mobile food unit, which blocks a truck from parking on a competitor's lot without that competitor's buy-in.
The same subsection layers on operating restrictions once a spot is chosen: no selling anything besides food, non-alcoholic beverages and directly incidental items; no more than one covered ten-by-ten table for condiments; no audible music or sound outside the vehicle; no signage that isn't permanently affixed to the unit itself; mandatory trash receptacles and proper disposal of all waste generated by the use; and no discharge of liquid waste from the unit onto the site.
Violations & Fines
A mobile food unit operating outside a qualifying commercial, mixed-use or perimeter zone, or violating the 100-foot residential buffer or restaurant co-location rule, is subject to permit revocation by the zoning administrator under § 26-324 for failing to comply with chapter 26. Because article X carries no separate penalty section, an operator who ignores the zoning restriction is also exposed to the general Code penalty in § 1-10, up to a $1,000 fine or six months in jail.
