Warrick County Code Section 41.02(F)(2) lists "mobile food vendor permits" among the Food category of fees the County Health Department may charge, alongside food establishment permits, catering permits, temporary event food vendor permits, micro market permits and vending machine unit permits. Section 41.02(C) requires that the amount of each fee, including the mobile food vendor permit fee, be established from time to time by resolution of the County Local Board of Health and approved by the Board of County Commissioners acting as county executive, under I.C.

16-20-1-27. Section 41.02(D) caps every fee at the actual cost of the service provided, meaning the Health Department cannot use the mobile food vendor permit as a revenue source beyond covering its own administrative and inspection costs. The current approved fee schedule, per Section 41.02(E), is kept on file at both the County Health Department and the County Auditor's office and is open for public inspection, so an operator can confirm the exact dollar figure before applying. Section 41.02(G) further requires that any fee correspond to an actual permit, inspection, review or record already authorized by ordinance or state law, and bars the Health Department from using a fee resolution to create new substantive permit requirements.
