Warrick County, IN Noise Ordinances: Construction Hours (2026)

Section 158.03(C), enacted by the Board of Commissioners' Ordinance 2023-14 on July 24, 2023, makes it unlawful to operate 'any tools or equipment used in construction, drilling, or demolition between the hours of 7:00 p.m. and 7:00 a.m. in such a manner that will disturb or annoy any reasonable person nearby.' The section carries two built-in exceptions. Under § 158.03(C)(1), work may continue overnight 'in the case of urgent necessity in the interest of public health and safety,' but only with a permit issued by the Office of the Board of Commissioners; that permit runs for up to three days at a time while the emergency continues and can be renewed in further three-day increments.

Under § 158.03(C)(2), the Office of the Board of Commissioners can separately grant permission for nighttime work if it determines public health and safety will not be impaired and that loss or inconvenience would otherwise result to a party in interest, with the application made when the work permit is issued or while work is underway. Outside those exceptions, the curfew applies only in unincorporated Warrick County; incorporated towns such as Boonville and Newburgh set their own construction-hours rules. The Warrick County Sheriff's Office enforces the chapter under § 158.07, filing citations with the Warrick Superior Court, County Division, through the Code Enforcement Officer or County Attorney.

A violation is punished under the chapter's general penalty in § 158.99(B): a fine of up to $2,500, with each day of continuing violation treated as a separate offense.
