3(1). The rule applies only to unincorporated Fulton County: Atlanta, Sandy Springs, Johns Creek, Milton, Chattahoochee Hills and South Fulton all enforce their own zoning codes for sidewalk and roadside sales. Vending is allowed only in C-1, C-2, M-1 and M-2 commercial and industrial districts, never in residential or AG-1 zoning. The Department of Environment and Community Development issues no more than two Administrative Permits per calendar year for the same site, and neither permit may run longer than nine consecutive days; applications are due at least 14 days before the event, and the approved permit must be posted on site and visible from the street.

Vendors submit two copies of an 11-by-17-inch site drawing showing distances from property lines, north arrow, curb cuts and traffic patterns, plus a notarized permission statement and 24-hour contact number for the property owner or lease holder. m. A vending site must sit at least 1,500 feet from any permanent business selling similar merchandise, keep a 20-foot setback from the right-of-way and a 10-foot setback from any internal drive or curb cut, and provide six dedicated parking spaces for the vending area alone. No table or cart may stand within 250 feet of a residential structure, no temporary sanitary facility or trash receptacle within 100 feet of a residential property line, and noise at adjoining residential lines is capped at 65 dBA.

Tents, tarps, sales from vehicles and advertising signage for the vending operation are all prohibited outright, and displays cannot block a fire hydrant, mailbox, driveway or other public access point.
